在申請人與澳大利亞公民或永久居民登記結婚後，就可以由後者提名，前者遞交配偶移民簽證申請。這類移民簽證申請有2個步驟：
如果申請成功，申請人首先會獲得壹個為期2年的臨時居留簽證，在這2年時間內，移民局評審配偶雙方是否***同生活在壹種真實而持久的密切關系中。在澳大利亞境內申請是V820類，在澳大利亞境外申請是V309類。
隨後，如果關系壹直維持，則可以申請永久居留的配偶簽證。在澳大利亞境內申請是801類，在澳大利亞境外申請是100類。
二、未婚夫妻
澳大利亞承認沒有婚姻關系的同居男女也屬配偶。該類簽證要來申請人在遞交移民申請時已經與配偶同居了至少12個月。這類移民簽證申請有3個步驟：
居住於海外的申請人，由其身為澳大利亞公民和永久居民的未婚夫/妻擔保，申請未婚配偶簽證。同時表明，您真誠希望和您***同居住的未婚夫/妻結婚。在簽證發出，申請人持簽證入境澳大利亞後，申請人會獲得壹個為期9個月的未婚配偶臨時簽證。
在此期間必須和擔保配偶註冊結婚。
2年後轉為正式永久居留簽證。
本類別只能在澳大利亞境外遞交申請。
所填表格的主要內容
申請赴配偶移民簽證，必須填寫澳大利亞移民部印制的47SP號表格，該表的內容包括8個部分：
第壹部分：申請概況（Application overview）

申請配偶移民的基本條件
壹、申請獲得兩年配偶臨居簽證的基本條件
1. 已婚夫妻類別:有計劃維持真實而長久的配偶關系（ Your relationship is genuine and continuing）。這種關系的存在是批準移民的關鍵條件。
2．同居夫妻類別:若是同居關系，該段關系在申請前已經持續了12個月 （You and your partner have been in that relationship for the period of 12 months immediately preceding the date of application）.
3．未婚夫妻類別:雙方年滿18歲 （Both you and your fiancé must be aged over 18 years）;有資格在澳大利亞依法結婚；真誠的希望於擔保人登記結婚，並維持真實和長久的婚姻關系；申請人於未婚配偶兩人相互認識，而且相互了解 （You and your fiancé have met and are personally known to each other）。
二、獲得永久配偶簽證的基本條件（Basic requirements of awarding permanent spouse migration visa）
上述的已婚、同居和未婚類別，如果在2年臨居期滿後能夠滿足下列條件，則可以轉為永久居留簽證：
1．已申請並持有臨居簽證已超過2年（持未婚簽證者必須已登記結婚至少2年）；
2．擔保人的擔保維持有效（即配偶沒有撤去擔保）；
3．與擔保人保持真實而長久的關系，***同生活；
4．擔保人的基本條件：
18歲或以上的通常在澳大利亞居住的澳大利亞公民或者永久居民（An adult（over 18）Australian citizen，Australian permanent resident usually resident in Australia）；
以配偶或未婚配偶身份擔保他人移民或被他人擔保移民澳大利亞沒有超過2次；而且，在過去的5年內未曾以配偶或未婚配偶簽證擔保他人或被他人擔保移民澳大利亞；
沒有從澳大利亞政府領取金額的養老金、補貼（It is unlikely that your assure could provide an acceptable assurance of support if they have received the full rate of any pensions or allowances from Australian government during the past year）。
在配偶類簽證類別中，移民法壹再地強調兩人必須維持真實而長久的親密關系。因此，如果該段關系破裂，擔保人在臨時簽證的2年期限內撤回擔保，則申請人將無法獲得永久居留簽證。
值得註意的壹點是，有關的法規雖然都訂立了嚴格的條件，但都有基於人道立場上的例外情況。例如，在涉及擔保人死亡、虐待配偶或雙方育有孩子等等情況下，申請人是可以不受擔保人撤回擔保的影響而依然獲得永久居留簽證的（Waiver of 2 Years Requirement）。
